After a Senate committee hearing Friday into November's fuel-line blast in Walnut Creek that killed five workers, state Sen. Tom Torlakson said he will push for tighter laws regulating how hazardous underground utilities are marked and how construction crews can avoid them.
Current methods of protecting utilities are "very ad hoc, and that's not right. That's not safe," Torlakson, D-Antioch, said after the two-hour meeting at Walnut Creek City Hall.
Workers who mark utilities may require special certification and should employ more advanced technology than they currently use, Torlakson said, echoing suggestions made by some speakers. He also suggested that fines levied for accidents may need to be heftier.
It was the first public hearing since the Nov. 9 blast, in which a backhoe operator installing an East Bay Municipal Utility District water main hit a buried fuel line, releasing a stream of gas ignited by nearby welders.
The catastrophe has prompted several investigations, a raft of lawsuits and calls for new laws. Officials from workplace safety regulator Cal/OSHA appearing at Friday's hearing said they would consider new laws and regulations after consulting a panel of state and industry experts next month.
"The thing that stands out about this incident is its disturbing simplicity," said Len Welsh, acting director of Cal/OSHA. "We need a system that is resilient to human performance errors."
Cal/OSHA last month blamed Kinder Morgan Energy Partners, saying it failed to mark a bend in its fuel line. It issued the firm two "willful" violations -- the stiffest possible penalty -- and fined it $140,000, while the utility district, the contractor and a mapping firm received "serious" citations.
Kinder Morgan officials, who say they properly marked the line and provided maps showing the bend that was struck, are appealing the ruling. Company officials did not attend the hearing, but sent a letter saying the firm -- which operates 10,000 miles of pipelines in 21 states -- is "retaining additional third-party expertise concerning line marking practices, " providing more training and education and buying "state of the art line locating equipment."
Currently, state law requires Bay Area excavators, before digging, to call a nonprofit service that in turn contacts the owners of any nearby underground pipelines and utilities. Those owners must locate and mark their lines or advise workers of their location. Should those workers approach the line, they must dig by hand to expose it and protect it.
But Torlakson, EBMUD General Manager Dennis Diemer and others asked why there are no rules specifying exactly when utility owners should, for example, use paint to mark the path of a line or dig "potholes" that expose the line from the surface.
Mark Breslin, executive director of the Engineering and Utility Contractors Association, which represents about 400 companies, said the Walnut Creek explosion was "only a symptom of a recurring and pervasive problem in marking utilities in the state."
Also at the meeting, state Fire Marshal Ruben Grijalva said his pipeline safety division was within two weeks of issuing its report on the Walnut Creek blast. He said his investigators also believe it was caused by "the line not being properly marked" and could seek fines up to $500,000.
"There was enough regulation and legislation in place so that this should not have happened," Grijalva said. "It just wasn't followed."

One day I was talking to a Candidate for Office the next he crashed into a mountain.  No one believed me in 2008 but today they are likely quite worried.

Open Letter; CEO Anthony Early




Dear Mr. Early, 



We share a common suite of events - we are both arson victims.  The difference between our situations vastly different as my story leads to Police Officers, Attorneys, Private Investigators, a long unchecked investment scandal plus a slew of verifiable fires, kidnappings, arson cases, and sadly a few murders connected to your employees or vendors that are also connected to my world.  


During the PG&E Engagement I had several attempts to take my life via accidents, beatings, muggings and while around town. I've been homeless off and on since 2010 which started right after I met a PG&E High Performance Engineer.  A retired San Francisco Police Lt. who was at the Piedmont Lumber (Fire/Arson) in 2010 was standing next to your Engineer.  I believe his job would be calculating little things like Pipeline Pressures.  


I've filed police reports but none have gone anywhere but the FBI, State and perhaps a few from Contra Costa County are actually doing something. 


While the Attorneys toss the workers away like pawns on a Chessboard one of the worlds largest utilities is clearly under attack but worse while the attorneys jostle PG&E faces a paradoxical issues.  The recent announcement by Jon Wellinghoff former Chairman of the Federal Energy Regulatory Commission and retired FBI Rick Smith but based on their statements I've been emailing ATF, FBI, State Investigators and PG&E Attorneys about what happened to my laptop that was breached several times.  


Your vendor placed thousands of sensitive PG&E documents on my laptop which was stolen in 2012 but recovered by the Walnut Creek Bomb Squad but lacking a decent explanation of where it was for 10 hours.  


On April 4th 2012 a pipe bomb found on the Iron Horse Trail is another dangerous incident.  This is the same mission critical location where Kinder Morgan Gate Valve is located which was shut down the 2004 Kinder Morgan 


There are several problems with the 2004 Kinder-Morgan Fire

  3. Students now adults interviewed separately consistently state they heard two explosions
  4. One of those students is the son of a friend - No one ever gave him a completed report on his sons drowning -  Williams, Mary Alicia Driscoll,
  5. The other witness is a Federal Agent / and partner whose first person pictures were stolen.  The person who stole the camera was arrested and sent to prison for a dubious murder case.

Arson vs. Accident or perhaps a well planned domestic terrorism attack.  


Walnut Creek CA:  In February 2010 I was approached via Craigslist.com by a PG&E Subcontractor for developing software related specifically to the San Bruno Arson Fire.  Please take note ARSON v. Accident that was well planned and years in the making.  

What you learn via my blog is that the son of PG&E Attorney was murdered but for this blogger it's very personal - I know the victim and he's not the only one.  

If you're a public employee working for a utility, a public agency or infrastructure organization or business person then learn about my story that covers covers fires, arson cases, kidnappings, murders, murder/suicides and lynchings of blacks in the 1980s.  


In my attempt to solve my own incidents the research would return other Kidnappings, accidents, and fires.  As the database expanded it started looking like an investigative case management tool but one thing is clear - the cases have many common characteristics such as pipeline fires near schools.

Back in 2001 my attorney was Don Moats who suddenly stopped appearing at hearings and kinda went comatose during the case.  I remember reading that his offices were burned down in Walnut Creek but I called the FBI over that event as I lost over 100,000 on that case and the FBI agreed but I'm suspecting they've placed FBI Agents in several police departments.

My next door neighbor worked for Bowles and Verna and he was flying back and forth to JFK filing all kinds of briefs - I always how this attorney with ZERO Aeronautical experience was the same courtroom as TWA Attorneys who were experts at defending those types of cases.

The Hedge Fund and the Real Estate Fraud case 


At this writing it's been nearly ten years since my 2004 Arson Fire and Beating.  Then one day I discover that Richard S. Kopf is connected to a Hedge Fund and near his Mormon friends are a series of investor fraud cases.  


I have many of the cases posted on this blog lead to Alamo 1st Mormons - this is going to be one of the most god awful in the "Name Of God" stories you've ever read.  

I am highly negative on RIchard S. Kopf as his wife arrived at my cabinet shop in 2004 with Brian Schwalen who died hours after attending services at Alamo 1st.  I remember him panting and practically gasping for air then hours later he's dead.  He was fine coming in but by the end of the service he's heading for the exit.  

I have other cases like Brian who I met many years ago long before he was a card carrying Mormon.

Update: Cigarette Set Teen Ablaze at Concord BART Station

Update: Thursday at 1:30 p.m.A teenage boy suffered significant burns when his clothing caught fire outside the Concord BART station late Wednesday night.

At about 11:35 p.m. Wednesday, police and fire crews responded to a report of a male on fire at the BART station, located at 1451 Oakland Ave., a Contra Costa County fire dispatcher said. When emergency crews arrived, they found the victim suffering from burns and airlifted him to a hospital.

BART police Lt. Mike Hayes said it appears that a short time earlier, the boy had been working on a car belonging to someone he met at a nearby store. While working on the vehicle, he spilled gasoline on himself.  The boy told police that the driver then dropped him off at the Concord BART station and lit a cigarette before departing, Hayes said.

Based on the initial investigation, Hayes said, it appears that the flame ignited the gasoline vapors coming from boy's clothing.  The boy then jumped out of the vehicle and stripped off his burning clothes, Hayes said.  He suffered significant burns to his arms and chest, according to Hayes.  The driver of the vehicle had left the scene before police and firefighters arrived at the BART station, and police have not been able to identify that person.  BART police Sgt. Tom Smith said no suspects are in custody this morning and that detectives are checking surveillance video from Wednesday night.
During the BART Engineer Accident investigation I met Lt. Hayes where I told him to look to the buildings to the south that the Plaintiff Attorneys winning millions upon millions in jury awards could see the accident scenes.  Taking that further I plotted suicides, shootings, fires (arson) and accidents where this pattern emerged that perch points were evident e.g. my 2004 Arson fire, the deadly Walnut Creek Pipeline fire in 2004 then the Caldecott Tunnel Fires was also the same perch point where Adam Williams and his mother murder suicide up on Lookout Point on Mt. Diablo.

A man was airlifted to a hospital after he was burned outside of the Concord BART station late Wednesday night, a Contra Costa County fire dispatcher said.

Crews responded to a report of a man on fire at the Concord BART station located at 1451 Oakland Ave. at about 11:35 p.m., the dispatcher said.

When crews arrived, they found a man who had been burned and airlifted him to a hospital. Further details about the incident were not immediately available.

Railroad says woman killed by train at Davis station not on cellphone

DAVIS, Calif. - The young woman hit and killed by an Amtrak Train in Davis Sunday night has been identified as 29-year-old Andrea Mrotz from Vallejo.
According to Davis police, at least one witness said Mrotz was on her phone prior to the train collision. At least one witness also tried to yell and warn Mrotz.
Officers talked to several witnesses including the train conductor. According to police, Mrotz, was in the danger zone.
Police say Mrotz was crossing the tracks when she was struck by the train.
Loved ones say Mrotz was an intelligent and responsible young lady who was familiar with the Davis Amtrak station and used the train regularly.
Alberta Jones says her niece was not someone who took things lightly.
"She was standing next to her belongings when she got hit," said Jones. "We don't know how she ended up on the tracks. That we don't understand."
Amtrak and Union Pacific Railroad were reviewing surveillance video from the incident.
"Until you see the video, we don't know how she ended on the tracks. That we don't know. She wasn't crossing back and forth. We still don't know if she was on her phone," said Jones.
Jones said Mrotz had an incoming call before the accident, but it was not certain that her niece was on the phone when she was killed.
Sunday night, A Union Pacific worker said there were additional passengers on the train because of the Raiders game. Mrotz's family believes the train was longer than usual. And, they believe there were a number of additional factors that may have contributed to Mrotz's death.
Amtrak and Union Pacific Railroad were not commenting on the investigation.
Mrotz graduated from UC Davis in microbiology several years ago.
According to her LinkedIn profile, she was a leader and organizer of LabelGMOs: California's Grassroots for the Vallejo and Benicia area. She stated that she organized group volunteer meetings and marches and advocated for sustainable farming practices.
On her Facebook page, Mrotz has many posts about her activism in public health and protecting the environment.
She was also an avid and accomplished sailor and often taught people how to sail with the Benicia Yacht Club, according to relatives.

Walnut Creek CA: Sometimes the brutal truth needs to stated.  In Sept 2014 as I was about to enter the crosswalk a driver raced up towards me well over 75 mph.  In most cities this would be attempted murder and investigated with great dispatch.  Given that I was nearly killed in Walnut Creek CA near Safeway at 500 South Broadway most officers especially the town council (Walnut Creek City Council) could a give a shit whether I live or die.  
Help! Hear me speak at the Walnut Creek City Planning Commission meeting where Councilman Simmons called the police in an attempt to Quelch my public voice and a dash of free speech or better they'd rather see me dead?  In July I wrote a follow-up letter to my June City Council Appearance - in that letter I stated coming forward will likely get me killed - That letter was deliberately sent to FBI, US Attorney, CEO Mace Rich, Nordstroms GM, and Nieman-Marcus.  
Mormons
I used to attend church at Alamo 1st Alamo CA on Stone Valley (Mormon) where just about every member knew my F-250 exploded on NB 680 between El Cerro on-ramp and Stone Valley Road.  My former Mormon friends have gone AWOL ever since Nate Greenan turned up dead.  

The Mormons are generally giving people but with me they're not interested and yes I've emailed them.  The Bishops are well aware that I've spent nights in the freezing weather but after my Lafayette Event they've been nowhere to be found and most run when they see me - is it possible that one of the members rigged my truck for arson - actually based on series of personal investigations I figured out that Gregs Muffler (Mormon) had a lot to do with that fire.  





Most have never knew or have forgotten that Jason Watts was once a Nordstrom's employee killed by Walnut Creek Police.  My ex-wife worked at the Walnut Creek Nordstrom's and they've got a suicide from their Cafe?  I've documented endless cases near me and you can't find a single police investigation ever completed in what I'm saying are near serial murders and attempted murders.    

Our children have been targeted with high speed accidents, arson, and beatings but no one gives a shit in Walnut Creek to be frank as one can be.  I'm the guy being attacked over and over whose litigation history includes at least four murders with defendants or plaintiff's during his 30 years of court drama.

When I appeared at the Walnut Creek City Council meeting I clearly stated people near me are being murdered and that other homeless were going down.  I do my best to keep track of who is vanishing.  The Walnut Creek Police routinely violate civil rights of persons deemed not-desirable - it's an offshoot of "The Final Solution" where they cleanse the streets which is an offshoot of the Ultimate Final Solution we've read and fought over in WWII.  

Letters to Mace-Rich, Neiman-Marcus, Nordstroms and soon every corporate entity that operates the "The Feel Good Look Good Trinket Pushers" or basically they look the other way while people are being killed around their happy town.  


See you soon at City Council Meeting where they will try to arrest me for meetings that haven't started and soon I'm planning to talk about the Mormon from Alamo 1st that is fully aware along with the Bishops, Elders and members that my truck exploded with me in in 2004.

Walnut Creek CA: Some may wonder why I'm homeless and unable to get back to work.   The reality is I've been targeted by police officers via this scandal but not limited to CNET Scandal where numerous police officers have been sent to Federal Prison over a divorce scandal involving police officers, attorneys and companies feeding their pockets with the H-1b visa that I know believe was interwoven with the cops. 

IN 2001 someone burned down the offices at 1776 Ygnacio Valley Road Walnut Creek CA and it was arson.  In 1988 someone set fire to vehicles at my cabinet shop in Pittsburg CA while in the same time period they blew up an IRS Agents car in Walnut Creek, Killed a SFPD Offices and while on top of that murdered my friend Cynthia Kempf (Kempf 1988) who was abducted and killed during a takeover robbery.  Now 30 years later I'm seeing the same pattern leading back to the same points.  


In 2002 I began writing about the H-1b visa noticing that I wasn't getting gigs but the foreign tech workers were doing fine.  Those articles eventually landed me on CNN, ABC and the San Francisco Chronicle but in 2004 someone blew up my truck and 2013 Five Filipino Women were burned alive on the San Mateo Bridge but three months after my truck burst into a fire ball - the Kinder Morgan Pipeline Fire burned five men alive in Walnut Creek CA.  The bigger problem with my story is I've got witnesses but no police report.  In the Kinder Morgan Fire the main witness is dead but in the Police Corruption cases there are five dead witnesses.  

The Medical Drama 
In 2003 a series of well orchestrated attacks began but back then I didn't see them as attacks but a run of accidents and medical.  The medical drama ranged from constant intestinal problems to near fatal poisoning.

California (AP) -- Inattentive driving may be to blame for a Friday morning bus crash that sent nine developmentally disabled adults to area hospitals, Walnut Creek police said.
About 9 a.m. a small bus operated by San Francisco-based Trans-Metro Express carrying nine passengers with various disabilities crashed head-on into a concrete pile on Lilac Drive under Interstate 680, behind Kaiser Hospital.
All nine passengers and the driver were taken to three different hospitals. The driver and one passenger had serious injuries but were stabilized at John Muir Medical Center, Lt. Loren Cattolico said.
The driver may have been talking to passengers when he veered left onto an island and crashed into the large concrete pillar, Cattolico said.
Cattolico did not release names of the driver or passengers, saying the reports would not be completed until Monday or Tuesday.
Buses from several companies contracted by the Regional Center of the East Bay pick up about 2,500 developmentally disabled adults every day and take them to hundreds of centers and programs in Contra Costa and Alameda counties, said Jim Burton, executive director of the center. The Regional Center coordinates the programs and transportation for each of the participants in the East Bay.
The bus that crashed Friday morning was on its way to Christmas parties at two vocational centers in Lafayette.
"They're not capable of traveling independently so they're picked up by this bus company," said Jacquie Allen, program director at Futures Explored, one of the centers.
Allen hurried to Kaiser to help identify the passengers and contact family members when she heard about the crash.
"They just looked like they were scared," she said.
Allen brought two of the passengers back to Futures in time for part of the Christmas festivities.
Some of the clients at Futures can't speak and firefighters had difficulty communicating with them.
Six of the moderately injured people were taken into Kaiser for evaluation, in case they were not able to alert rescue workers to an injury, a fire official said.
Neither Allen nor Burton could recall a traffic accident in the program in recent history.
"This will be thoroughly investigated," Burton said.
The Regional Center began working with Trans-Metro Express for busing about a year ago, Burton said. The California Highway Patrol had no record of citations or accidents for the company.
A company spokeswoman referred all questions to the Regional Center.



Caltrans inspectors said the crash did not damage the support pillar, Walnut Creek police reported.
