On the Hillgrade Ave but to understand my concerns first visit this article.  Then you'll see what I've found - the KM valve used to close down the deadly 2004 Fire was possibly targeted

Pipe Bomb Found on Hillgrade Ave

The Hillgrade Event
County Report on Pipeline Concerns - Take a little time to think what could of happened on April 4th 2012 and this event very critical from my perch, on March 30th John Newman was murdered in Concord and Nate Greenan was murdered in Orinda on April 18th but these just a few of many but the one everyone should question is what happened to Ellen Sabaquira who a key witness in the 2004 fire.
Pipeline Concerns - I'd be very concerned

Then read this report that details the efforts of Kinder Morgan crew who closed the Hillgrade Ave valve to stop the flow of fuel to Broadway Extension Fire.

Pipeline Failure Investigation Report

I lived in Danville for 10 years, shopped at Safeway in Alamo, Roller Bladed down the trail over 100 times.  Every fireman will tell you - the west side Alamo/Danville is a tinder-box of fuels from overgrowth, housing and cars that hasn't experienced a fire in 50 years.

My truck fire was 680 3/4 miles north of El Cerro Blvd.

I am  pointing out what has become obvious - bigger that Oakland Hills Fire but .... the Arsonist Clock is ready strike again.

Worries over jet fuel pipeline along Iron Horse Trail get county action   Contra Costa Watch

You want to be worried - I've been complaining for nearly ten years about my truck fire.  I've been targeted many times and it doesn't matter how many police reports I fire it's always a dead end.

Perhaps now they will be worried but burning down these houses has an economic upside as they could then shop in Walnut Creek - the trinket sellers would have new customers.  Let's hope the only thing that happens is nothing but there is a big problem .

TWA Flight 800 - The 1989 thefts from the San Pablo Armory

When Contra Costa Narcotics Commander Wielsch was arrested with Chris Butler(PI) in the Dirty DUI Scandal the first clues surfaced about what I've endured. My CNET related litigation would have revealed CNET in 2004 but I couldn't get my attorney to bring suit. It dragged on until late 2005 until the attorney was beaten - case closed. All of this precedes the PG&E and Kinder Morgan Fire.

Please see Informed Parties Timeline.

See Attorney Sage Sepahi Beaten - Walnut Creek.

It runs the gamut of tactics used on litigation in Contra Costa County but some cases are well over 20 years old. One critical case to my argument is currently buried by Pleasant Hill Police stems from an arson/murder, a murder plus the arson of a chemical shed once known as the Cabbage Patch in Pleasant Hill CA. Which is currently known as the Cabbage Patch Farm.

Domestic Terrorism - The Real Agenda

The Lafayette accident was clearly a deliberate attempt to kill me but please read the letters to Lafayette PD and City Council

The laptop was in the custody of Hillside Covenant Church members but just two days before the accident Keith Lynds (Youth Director) messaged me via Facebook with near clairvoyant accuracy as exactly where my Facebook account had been hacked.

How did know because he and other Hillside Covenant Church coerced my minor son who took over managing my social media. Then after the accident Captain Schultz attempts like Lt. Hill and Sgt. Burns attempt to arrest me with veiled allegations with hands on their guns or damn close to them. Officer Vesser ticketed me front plate Judge Golub turned that into an 1,800 fine. I remember that day where nearly five officers arrived, two from behind me with hands on their guns.

In 2008 Walnut Creek Police announced a break in a case using FBI voodoo science but they weren't expecting my information would surface to derail their charade. They're going to ruin former Mayor Newsome's political career and that of many others as thy are lying but the liars no longer have access to the files.

Just another Contra Costa pipe bomb or International Terrorism?

The Hillgrade Ave event is a game changer. Caldecott Tunnel: Eight hospitalized after smoky car fire

By Erin Ivie eivie@bayareanewsgroup.com
POSTED:   11/01/2013 10:28:57 AM PDT | UPDATED:   3 DAYS AGO

OAKLAND -- Moments after thick, black smoke filled an eastbound bore of the Caldecott Tunnel on Friday morning, hundreds of motorists abandoned their cars and fled the tunnel, many clutching children's hands and carrying dogs.

"I was in my car, when all of a sudden, one or two people walked past me, then three or four, then five, then six," said San Ramon resident Kevin Watkins, whose car was stuck in the bore. "I got out and asked what was going on, and someone said we were asked to evacuate the tunnel.
"It was kind of scary. It took everybody aback."
Seven children and one adult were taken to hospitals to be treated for smoke inhalation Friday in the aftermath of a blaze that broke out at 9:51 a.m., when a 1988 Acura Legend was engulfed in flames about 500 yards from the Orinda tunnel exit. The blaze, which fire officials think started in the car's engine, was contained about 10:30 a.m., though thick smoke remained in the eastbound bore for the rest of the morning.
Moraga-Orinda Fire Department Battalion Chief Sean Perkins said fire crews contacted the Caldecott control center and requested that exhaust fans be redirected to blow smoke toward Orinda to keep visibility clear for motorists exiting the tunnel on the other end. The fans were installed after an explosive 1982 fire in the tunnel that killed seven.
However, fire crews had to enter the tunnel from the Orinda side through thick smoke, with very little visibility, Perkins said.
"Engine 45 crept along moving a couple miles per hour until they reached the car," Perkins said.
MOFD firefighters, along with two Oakland engines from the other direction, extinguished the fire. The center bore was closed in case fire crews needed to access the affected tunnel through a passageway that connects both tunnels.
Watkins, 33, said he pulled up about 9:45 a.m. to the tunnel, which already was congested with the usual morning traffic. As he entered the tunnel, a California Highway Patrol officer pulled up with his lights on and moved everyone to the right side of the bore, effectively grinding traffic to a halt.
Soon after, Watkins said, every individual inside of the tunnel was asked to evacuate. Some pulled allergen masks from their car before leaving, or wrapped scarves around their faces to avoid breathing the smoky air.
Watkins grabbed his iPad and backpack, then hurried from the dark, smoky bore with an estimated 150 to 200 other motorists. The stranded commuters were asked to wait for instructions on the center divide for about 40 minutes, said Watkins, adding that officials asked the group if anyone was a nurse or an EMT.
"People were coughing a lot from the very beginning," he said. "I wouldn't be surprised to hear that people went to the hospital."
Oakland Fire Battalion Chief Lisa Baker said seven children were taken to Children's Hospital Oakland to be treated for smoke inhalation, and one adult was taken to Alta Bates. All hospitalizations were made as a precaution, she said, and no serious injuries were reported.
The 1982 fire in the westbound bore killed seven people after a drunken driver's stalled car, a speeding bus and an overturned gasoline tanker combined to cause a superheated, toxic fire, one of the worst tunnel fires in U.S. history. Inadequate monitoring, lack of changeable message signs or signals at the entrance and inside, and lack of communication between tunnel personnel and motorists contributed to the severity of the fire, the National Transportation Safety Board later concluded.
Today, tankers carrying hazardous chemicals are prohibited from traveling through the tunnel for 22 hours a day, and emergency responders are equipped with more tools, such as cameras throughout each bore, to react to emergencies more quickly and efficiently.
Signs warn the 160,000 motorists who drive through the three bores each day to slow for accidents, and wiring has been added for cellphone communication.
MOFD and Oakland firefighters train a couple of times a year for Caldecott Tunnel fire response, Perkins said. Usually, they shut down a bore in the middle of the night for training.
About 11 a.m., the middle bore of the Caldecott Tunnel was switched to accommodate eastbound traffic, CHP Officer Ron Simmons said, and all lanes of traffic in both eastbound bores were open by noon. Officials said a hanging electrical wire that briefly closed one lane of the right bore was caused by the incident itself, and it was ruled out as the cause of the fire.

PG&E Fire and the Gas Can Man

The original video can be found on Youtube but posterity purposes I grabbed a copy.  This video in my book matches persons I know live in the SF East Bay.  Depicted on this page are several "other" explosions.  The 2004 Walnut Creek fire was several months after my truck fire on 680.  The fire that San Ramon Valley Fire Protection District, CHP, Danville Police and  Walnut Creek Police refused to investigate.

This was in Walnut Creek in 2004.
This woman was a probable witness
She is dead

The Gas Can Man

The Mysterious Gas Can when I discovered the clip on Youtube had received around 10,000 clicks. After careful study several conclusions emerged, the rocks behind the Truck were likely from the blast. Those rocks could be used to calculate the strength of the explosion.
Frame by Frame Reconstruction: Using composite overlays one could construct enough of image to possibly identify what he's carrying e.g. Gas Can or Red Tool Box. The cameraman is yelling about the heat but the suspect doesn't appear to be in a hurry.

Photo by Gina Gayle/The SF Chronicle. A natural gas explosion ripped through a section of a Walnut Creek apartment complex yesterday afternoon, but nobody was seriously hurt or killed. The second-floor unit where the blast occurred was vacant and most neighbors -- perhaps because of the nice weather -- were out of the Park Regency Apartments when the explosion happened at 12:15 p.m. "It sounded like an airplane hit it," said Beverly Batton, who was in a first-floor garage at the time of the blast, having just returned from the grocery store. A Contra Costa Fire Department dispatcher said a man and woman, both 29, were taken from the scene to John Muir Medical Center. They were treated for abrasions to their face and extremities and released.

Walnut Creek Explosion Nov 2014

WALNUT CREEK, Calif. (KGO) -- Contra Costa County Fire Captain Kent Kirby says Friday morning's explosion in Walnut Creek has turned into a criminal investigation after police say this was not a gas explosion, but from a drug lab making hash oil - a concentrated form of pot. Around 10 a.m., fire crews responded to a two-alarm explosion at a six-unit structure at 1564 Sunnyvale Avenue in Walnut Creek, close to the Pleasant Hill BART station.

Death of Public Officials - These are not accidents

By PETE BENNETT - Contra Costa Watch EMAIL

The Witness Murders

They are all dead except the bottom three on the left.  I knew almost every victim and this was in 2013 but my first Dead Witness story started in 1982 with of my employee.

During November 2013 I intend to post a concise list of persons near elected officials or public office killed, endured untimely fates or have been murdered

This list is good and I have no reason to retract anything as my arguments of a problem with the recent crash of the PG&E Surveillance Plane was enough for me, 1) I knew the Matt Moody via a local club, 2) It's connected to the Gas Transmission Group, 3) it missed my sons and ex-wife by three miles and the person in Row 2 First Image from left is most likely my sons half brother but was my attorneys Dax Craven's half brother son of a attorney that works for PG&E, Contra Costa County, Seeno, Safeway and Several other firms all of which have been litigation quagmires for me.

Victims:

  • Five are Public Officials, Servants or Elected
  • Three are police officers (arrested and Convicted) - I know all of them some since 1988
  • One was a cop murdered who was photographed by my stalkers
  • Three are relatives of Public Officials
  • Three of the Public Officials have died of Spinal Meningitis- there are more cases
  • One is my attorneys brother in-law his father represents Seeno who is going to be finally indicted.
  • One was my neighbor
  • My long time karaoke DJ friend, his mother formerly with Solano County DA

  • Another was a Starbucks Barista,
  • One was a bartender whose high school friend was Butlers Decoy in the 48 hours special.  She's still around gained some weight and went Blonde - she no longer shows her cleavage.
  • The other was murdered and key suspect is a cop, has always been a cop.

There are many more names but you can take this FBI where they'll they know already..

Every victim except one was killed in the last two years.

Walnut Creek CA:  In 2011 I was contracted to work for PG&E for project that sort of fell from the sky.  Looking back I know something was wrong about how I was hired, what I ended up with on my laptop was enough for a domestic terrorist to carry out a wide range of attacks on PG&E infrastructure.

In the coming days I'll be posting the scenarios on how it could be done but I'll be using real world events already concluded and perhaps with flawed investigations.  The information Silos are part of the problem.

My personal challenge is a place to live - even though PG&E main defense counsel has been well aware of events near me and are well aware of my allegations.  I've called about 20 times for two years this The Homeless Programmer continues to endure attacks, his roommate tossed him for his own safety when he was mugged in Walnut Creek, I was mugged in Oroville, my car was totaled in Lafayette but it's far worse as former Senators Rainey and Perata have lost family members.  My ex-wife knows the Raineys, I knew their nephew as Uncle Fester from Tike Toms a fun loving guy who committed suicide, and Don Perata's daughter in-law drowned just like Margaret Lesher drowned but former Contra Costa Times reporter Michael Taugher drowned in Maui by vanishing from the surface while snorkeling but ..... he was another State of California Employee as he was the PIO for the Fish and Wildlife (Game) who wrote hard hitting well deserved pieces on Seeno and other power names in Political cricles.

This resident has called the elected officials DeSaulnier, Bonilla, Buchanan plus has emailed the Council of Mayors the day before he appeared on August 2rd 2012.  Few know this but Supervisor Anderson is Mormon, she is a member of the Danville Stake where the San Ramon, Alamo and Danville Wards operate under one entity.  She knew Ernie Scherer, and definitely knows James Greenan and Nate Greenan and Ernie Scherer III would attend the same Danville Area Stake Functions like Pioneer Days, General Conference and Emergency Preparedness events held at the Danville Ward on Old Orchard Way Danville CA.

That was where Mike Shimansky told me they were too powerful and couldn't stop them.  We were talking about the attempted murder of me by this man who fell to his death five weeks after I gave documents to the Chief of Police Joel Bryden and City Manager Ken Nordoff then the target of my litigation once linked to CNET nearly eight years falls to his death.

The experts of staging accidents are incredibly good or they have friends where they need them.  Read about Mr. Collins tragic fall in Palo Alto on Dec

This lawsuit would have stopped CNET in 2004

Walnut Creek CA: I am growing endlessly tired of trying to raise my sunken ship that riddled with holes where Police Officers arrest me, accuse me, sue their weapons in a show of force all too often.

In 2011 I was working for PG&E Software SubContractor and during this engagement I had two events to harm me.  On my return trip from Modesto Operations someone attempted to flip my car near Tracy Blvd on the 405 and then successfully totaled my car in Lafayette CA.

When I contacted PG&E I discovered the usual wall but their corporate counsel suggested I contact the Labor Board and I said how did I get hired in the first place?

This posting is a starting point for what I've discovered since that July 2011 accident - that accident was planned and the Lafayette Police were well informed about events.  You won't see a police report for that accident but I can tell you with a high level of confidence that it's linked to the following fatal accidents: Charles Silverman, Roma Bhatia, David Schafer, Loretta Hale, Carol Davis, two motorcyclists on Hwy 4 East Bound at Alhambra, and the following plane crashes of Eric Nunn (candidate) & Craig Wilson (BART), Peter Branagh (Know him), Matt Moody (know him), and my stint developing databases for PG&E Hydrotest operation leads to one core conclusion - my PG&E stint was a setup.

Alternate Explosion Theory Contra Costa Fire Timeline (or view this sheet)

Since the 2011 Accident I've attempted to resolve events

  • Reaching PG&E,
  • Called the ATF,
  • Checked Commander Wielsch's history,
    • Learned he likely possesed C-4 explosives (published news)
    • 02-2011~Attempted with Chris Butler to sell C-4 (Recorded By UC CAL-DOJ)

In July 1995 - TWA Flight 800 crashed - there has endless missile debates with the phoney CIA "NOT A MISSILE" produced in 1998 then in 2012 former NTSB investigators put their reputation on the line while resurrecting the missile theory.

The timeline fits nicely 89 theft, 96 Air accident, 2004 Kinder Morgan jet Fuel Explosion, PG&E Pipeline Explosion, and in the middle is me with a undetected Arson case where my truck was on fire with flames shooting back over 100 feet (According to CHP Motorcycle) but even with all my protests about Arson no one wanted to listen.

For many years I asked fireman, officers and others how my truck fire was NOT arson.  The general feeling what do you mean they let you drive away - i said whatever was in the engine blew out but the oil plug was down over 2 1/2 turns.

The unlikely answer came from a tow truck driver who aptly says - they replace the oil Kerosene or Jet Fuel then reseat the plug with a Wax Seal and wait.  That's why the mechanic from Greg's muffler was right behind me that morning.  I drove the damaged fire damaged truck to Gregs shop where his mechanic blurted out what he witnessed my truck on fire and therefore we have a witness.

Nearly ten years later I'm building a concise timeline of fires covering pipelines, gas, fuels, house, commercial building, and autos which happens to include Limos.  Then I'm reading up on the Kinder Morgan Fire - I was there that day at the courthouse getting fined by Judge Golub (you suck Joel)

It was clear to me a weeks ago (Oct. 2013) that my undetected arson fire with a likely fuel source of Jet Fuel would have weighed considerably in the investigation.  The Kinder Morgan Fire was referred to as "Pillar of Fire" and mine was best described as a fireball.

Well way back in 1979 I lived on Santa Monica Drive Pleasant Hill CA which was next to the Cabbage Patch where the there two murders about 1000 feet from my house.  One was murder the other was arson murder and the farmer was under a lot of pressure to sell.  Well they got him to sell when his chemical shed blew up.

During these events there were thefts and a 1918 Muni Railway Model T type flatbed truck complete with the old railway emblems on the door was stolen and went right by my house.

It was being towed out by Charlie (amazing but it was my former neighbor from Geary Road) with a tow truck belonging to North Main Tow (AAA Services).

Find that truck build a timeline of where it's been since 1979 or 1980 and I suspect it will lead to some rich folk in Contra Costa County.  The truck will lead to Murder Cover Up at the Cabbage Patch as the Pleasant Hill Police Department like Pittsburg won't talk about certain cases and all of these agencies are incredibly good at ignoring so many attempts at taking my life.

I no longer believe the PG&E fire was an accident and after building up numerous conceptual motives, methods and tactics I've concluded the recent BART accident is connected to the 2008 accident.  There are several common elements to the Asiana Crash, PG&E, ConFire, and BART - they operate on unsecure channels.

I went to the NTSB accident reconstruction scene for the Fatal BART Engineer accident

I'm gonna smoke some crack today stolen from the evidence lockers by Chris Butler who was in my house in 2004 who probably beat up my attorney in 2005 who likely set my truck on fire in Summer of 2004 is likely connected to the Kinder Morgan Fire where five workers were killed three months after my truck blew up on 680 and since the Walnut Creek Bomb Squad is connected to Weilsch, that connects them to Butler, that connects Butler to a suspect unnamed that I know grew up a few miles from the San Bruno Fire.

It doesn't get better from here as the GAS CAN MAN - these cops, CNET, SWAT and Walnut Creek BOMB Squad  all know this cop - there is a link between them and this Arson Fire that the FBI investigated which ConFire and Walnut Creek Police never occurred.  The reasons why are connected to my case being litigated from that office.  This fire links suspects to my 2004 Arson Fire, Cameo Acres Burnville which leads to my open to San Ramon Valley Fire Protection District as would drive past an obvious arson fire where the 911 calls stated openly that flames were shooting back over 100 feet but worse who would kill my attorney Divorce Attorneys Brother In-Law Nate Greenan or the same building inspector who nearly killed me in 2004 - The faces in here are critical

Suspect ex-cop in drug thefts also sought to sell explosives

By Contra Costa Times,Malaika FraleyRobert Salonga

Tue, 03/01/2011 - 10:49am

MARTINEZ, Calif. -- A Concord, Calif., private investigator tried to find a buyer for two bricks of a military-grade explosive in the days before he and a drug task force leader were charged with selling and conspiring to sell large quantities of drugs, according to a search warrant affidavit.
Norman Wielsch, the head of the state-run Central Contra Costa Narcotics Enforcement Team and private investigator Christopher Butler are expected to enter a plea Wednesday to 28 felony charges that allege the longtime friends sold marijuana, methamphetamine and steroids that had been seized by the narcotics team.
Butler allegedly told a confidential informant in the case that Wielsch, who he called "uncle" in many conversations secretly recorded by state Department of Justice agents, was looking to make extra money before his retirement. The informant said Butler was being audited by the IRS.
The pair was selling drugs, an informant told the Department of Justice, which oversees the now-suspended task force, on Jan. 21, three days after informant saw Wielsch speak to the media about a pipe bomb investigation at a storage locker, the affidavit says.
The state DOJ had begun audio and video surveillance on Feb. 2 when the informant gave Butler money for marijuana and steroids that Butler had obtained from Wielsch. Butler then asked if the informant could find a buyer for two bricks of the explosive C-4. The informant said that was unlikely.
"Butler tells the (informant) that if it can't be sold, he would 'give it to uncle (Wielsch)' so that he could 'say he found it in a search warrant,"' an investigator wrote.
That much C-4 could cause serious structural damage to a home but would not be enough to destroy a big officie building, said Sgt. Jay Hill of the Walnut Creek Police Department bomb squad.
It appears from the affidavit that Wielsch and Butler conspired to sell drugs that either were about to be destroyed or had been newly seized.
The pair allegedly discussed in wire-trapped phone calls when other narcotics task force members would be out of the office for training, the most opportune times to steal drugs.
Wielsch and Butler also were recorded planning to sell a pound of crystal methamphetamine for $10,000 -- the most lucrative sale detailed in the affidavit -- before the drug was scheduled for disposal.
"What if we just went in there and swapped one out with flour, no one is going to test it, and then we can just take the flour to the dump," an agent wrote that Butler told Wielsch.
"Well, the problem is, that it's at the Sheriff's department ... that means I have to go get it, and it looks pretty weird if I got get just that one," Wielsch reportedly responded.
"(Special Agent Supervisor) Wielsch continues by explaining that if he goes on Tuesday with a court order, he can take all of it as if he were going to destroy it, and adds 'no one is going to take a second look,"' an investigator wrote.
Butler's attorney, Bill Gagen, declined to comment on the affidavit. Gagen is expected to argue Wednesday that a judge should lower Butler's bail. Butler, a 49-year-old Concord man, has been held in lieu of $900,000 bail since he and Wielsch were arrested Feb. 16. Wielsch, a 49-year-old Antioch, Calif., resident, posted $400,000 bail on Feb. 18.
"I am not willing at this point to make any statements about discovery, which may take weeks," Gagen said. "There's a lot being looked at way beyond Chris Butler."
Wielsch's attorney, Michael Cardoza, said Monday that he hopes that he can reach an agreement with prosecutors to avoid a trial for Wielsch.
"It doesn't make sense to try this with a jury. The evidence we would have to face is daunting, and on the other side, the entire (narcotics) task force will be splayed on the news," Cardoza said. "If we can resolve this, it would serve us all much better."
Cardoza said his client was strained by the physical tolls of a 20-year career in law enforcement and the rising cost of caring for his ailing daughter.
"That's not by way of an excuse, but an explanation," Cardoza said. "It's not like he was a bad guy all these years. This thing just started a couple of months ago and the amount of money involved was peanuts. At the logical and rational level, this makes no sense."

An energy company was convicted Friday of six felony counts and will pay $15 million in connection with a 2004 gasoline pipeline explosion in Walnut Creek that killed five construction workers and injured four others.
Attorneys for KMGP Services Co. Inc., a subsidiary of Kinder Morgan Energy Partners, entered no-contest pleas before Superior Court Judge Terence Bruiniers in Martinez.
The company will pay a $10 million fine in the criminal case, involving violations of the state labor code, and $5 million to end a related civil prosecution, Deputy District AttorneyLon Wixson said.
"We're happy with it," said Wixson, who filed charges against the company Thursday after a lengthy investigation. "We think it's fair. We think it's appropriate."
Tom Bannigan, president of Kinder Morgan's products pipeline business, said in a statement, "We extend our deepest sympathies to the families and individuals affected by this tragic accident. While it can never make up for the losses associated with this incident, we hope that accepting our share of responsibility and reaching these settlements will help bring closure to this matter."
The families of the five men who were killed and others who were injured by the blast have reached separate civil settlements totaling at least $69 million with Kinder Morgan and other companies that were involved in the incident, including Mountain Cascade Inc. of Livermore, a contractor for the East Bay Municipal Utility District.
Only the subsidiary of Kinder Morgan, the nation's largest underground fuel shipper, was criminally charged.
The explosion occurred Nov. 9, 2004, when a Mountain Cascade backhoe operator was installing a water-district main near Newell Avenue and South Broadway and punctured a high-pressure Kinder Morgan pipeline.
The plea agreement signed by Kinder Morgan says the company was the "proximate cause of the puncture of the line and of the deaths and injuries that resulted from the incident." As part of the agreement, the company's employees must fully inspect its pipelines during excavation and conduct an audit of its training procedures.
Kinder Morgan had failed to mark a bend in the Walnut Creek line, according to state workplace safety regulator Cal/OSHA, which found the Houston company primarily at fault and fined it $140,000. The state fire marshal fined Kinder Morgan $500,000. The company has appealed both fines.
Killed in the blast were project foreman Tae Chin "Gene" Im, 47; Javier Ramos, 35; Israel Hernandez, 36; Victor Rodriguez, 26; and Miguel Reyes, 43. The fireball also seriously injured welders Jeremy Knox and Roger Paasch, pipe fitter Miguel Fuentes and crane operator Patrick Farley.
David "Max" Beach, the attorney for Reyes' family, said Friday that Reyes had been killed because the company "did not take safety seriously."
He said Reyes' relatives were grateful that the Kinder Morgan subsidiary had been prosecuted, but added, "It's impossible to say whether the resolution brings any measure of satisfaction to the Reyes family."
John Anton, an Oakland attorney who represented the families of Rodriguez and Hernandez, said, "Considering the misconduct, which was always egregious and is now criminal, and the loss of life that resulted, I can't say that I'm satisfied. I will say that Kinder Morgan, however reluctantly, stepped up to the plate and acknowledged, in both the civil and now the criminal litigation, the horrible blunders that its people made."
Last year, the federal Pipeline and Hazardous Materials Safety Administration's Office of Pipeline Safety and Kinder Morgan agreed that the company would provide system-wide safety upgrades in six Western states. The upgrades were expected to result in as much as $90 million worth of safety improvements.
The $5 million in the civil case will be divided among the county, a state and county prosecutors' fund for worker-safety investigations, the sheriff's office for its use in improving radio communications, the city of Walnut Creek and the Contra Costa County Fire Protection District.
